Federal law protects merchants’ ability to offer discounts for cash payments. Under 15 U.S.C. § 1666f, cash discounts must be clearly disclosed and available to all prospective buyers.
Visa’s published guidance permits merchants to display the regular card price or both cash and card prices side by side. Adding a fee to the posted price at checkout may instead be treated as a surcharge.
